Terms of Service

Welcome to draft., the architectural design practice of Carly Cowley (“I,” “me,” or “my”). By engaging my services or using my website, you agree to the following Terms of Service (“Terms”), which govern all residential and commercial architectural design work provided by me.

1. Scope of Services

I provide professional residential and small-scale commercial architectural design services. Each project is defined by an individualized proposal or agreement outlining the scope, deliverables, optional add-ons, and fees.

Residential Services include:

  • Construction-ready drawings for new home builds, including cover page, site plan, floor plans, exterior elevations, and roof plan.

  • Optional add-ons: Electrical plans, foundation plans, interior elevations, architectural details, 3D renderings, and virtual walkthroughs.

Commercial Services (renovations only) include:

  • Base packages by project size (<5,000 sq ft, 5,000–10,000 sq ft, >10,000 sq ft), with cover page, site plan, existing and proposed floor plans, and key interior elevations.

  • Optional add-ons: Electrical plans, 3D renderings, finish schedules, reflected ceiling plans, code summary sheets, and door/window schedules.

3D renderings are only available as an optional add-on to architectural design services and are billed separately.

2. Client Responsibilities

Clients agree to:

  • Provide accurate project information, measurements, and goals.

  • Respond promptly to design drafts, requests, and approvals.

  • Obtain all necessary permissions, approvals, or access for the project site.

  • Coordinate construction and contractor activities independently.

Delays in communication or incomplete information may impact timelines and may result in additional fees.

3. Payment Terms

Unless otherwise stated in your project agreement:

  • A 50% non-refundable deposit is required before work begins.

  • The remaining 50% is due before final deliverables are released.

  • Invoices are issued electronically, and receipts are provided upon request.

  • Accepted payment methods (U.S. only): Zelle, Wire Transfer, Venmo, PayPal.

  • Late or missed payments may result in suspension or termination of services. I reserve the right to pursue legal action to recover any outstanding fees, including associated costs.

4. Project Location & Availability

I operate out of Nashville, TN, and serve clients throughout Middle Tennessee.

  • Site visits and on-site consultations are available within this region only.

  • Virtual or off-site meetings are available at $100 per meeting.

5. Site Visits & Meetings

  • Site Analysis/Visit: $250 – includes on-site consultation, photos, videos, and measurements.

  • Virtual or Off-Site Meetings: $100 – design consultation or feedback without a site visit.

6. Timeline & Rush Services

  • Standard Turnaround: Approximately 4 weeks from deposit and receipt of all necessary information.

  • Rush Service: $950 fee for expedited projects, typically completed within 10 business days.

Timelines may be affected by client responsiveness or revisions outside the original scope.

7. Revisions

All revisions within the original project scope are included at no extra charge.
Significant changes or additions outside the original scope may incur additional fees, agreed upon in writing before proceeding.

8. Intellectual Property & File Rights

  • All design materials remain the intellectual property of Carly Cowley until full payment is received.

  • Upon full payment, clients receive a non-exclusive, non-transferable license to use final deliverables for construction, permitting, and project coordination.

  • Clients may not reproduce, resell, or distribute design files for other projects or commercial purposes without written consent.

  • I retain the right to display completed work in my portfolio, website, or social media, unless requested otherwise in writing.

  • The original title block must remain visible on all shared copies.

9. Termination

Either party may terminate the project with written notice.

  • If the client terminates before completion, the deposit is non-refundable, and the client is responsible for any work completed up to that point.

  • I reserve the right to terminate services for non-payment or breach of these Terms.

10. Limitation of Liability

To the fullest extent permitted by law, I am not liable for:

  • Indirect, incidental, or consequential damages;

  • Delays caused by client inaction, third-party contractors, or external consultants;

  • Construction outcomes based on altered or misused drawings.

My total liability for any claim shall not exceed the total amount paid for the specific service giving rise to the claim.

11. Governing Law

These Terms are governed by the laws of Tennessee. Any disputes shall be resolved in the appropriate courts located in Tennessee.

12. Updates to These Terms

I may revise these Terms at any time. The most current version will always be posted on my website. Continued use of my services constitutes acceptance of any updates.
